Hey Guys! I thought I would like to get your guys opinion about the fact Youtube is banning members who post videos of video gameplay. Well, What do you guys think?  I personally think this is bullshit.  The members who post gameplay are posting it for entertainment purposes and should not be targeted, when people are clearly posting music videos without consent from the original author.

Technically videos of gameplay are covered in the copyright the game publisher has over their game. Youtube *has* to enforce copyright if asked. If they refuse a takedown request, they can become liable for the actions of their users (that's the whole point of DMCA takedowns - Youtube isn't held responsible for their users' content, but only if they do act if it's brought to their attention). So, if they get complaints, it's not like they have a choice.

I'm pretty sure this only affects users who have monetized game-play videos who aren't partnered with say Machinima (Yes, I know Machinima is crap now. First thing I thought of.) or other partnering companies. Because even though it's your video, you don't own the game itself therefore you're making money off someone else's content.

IMO, its good in a way. Just see the media section; so many people keep posting hours long gameplay videos. I mwean wtf? Everyone has this game and this mod so everyone knows what it looks and feels like. Its not doing any good to anyone. Its another thing if a specific guy is doing commentary and he is "funny" at times and thats why he's being subbed over and over but that would be a rare case. Right now, all I see is "Plz sub me, I beg u!!!", "A vid I made of LCPDFR. Its pretty impressive if you ask me. Hit the like button below.", "Y I no get more subs? :'(" and shit like that. IMHO, its basically almost useless trash being accumulated over at YT, because there's no point in uploading these "HD" and big file-size videos as only either their own clan members or unemployed, idle people around the world bother to take a glance at them. Yes, they do hit like/subscribe without even watching the video, most of them do it just because the uploader's a friend.

I don't quite understand your reasoning behind this. People shouldn't be allowed to do what they want with their YouTube channel? It's not like they're taking precious space away from other people or anything with their videos. As for your last statement about the demographic for these "hour long videos".. Well, I'm employed and know none of these people, but I occasionally enjoy watching other people play LCPDFR, because I can maybe get some tips out of their gameplay videos even if they don't do commentary. Infact, a non-commentary LCPDFR video was what got me interested in the mod in the first place. 

Lets hope Rockstar Games doesn't go with the banning of gameplay videos on YouTube, or else I'm a goner. (Even though I post credits to everything I've used in the video and acknowledge what I do and don't own)

The only company I have heard that's taking a formal stance against YouTube gaming videos is Nintendo as they have claimed ownership of many videos created with their content in it.

 

 

 

I personally think it's a very bad idea to take action against videos, it  is the most powerful marketing tool  out there, I have bought many games after watching a lets play, I usually watch a couple of game play videos of a game before I buy it to ensure it's a good game.

 

Take-two (and a couple other companies) have a different policy, they do not object to people using their games in videos as long as they do not "spoil the plot" of the game, they are also not allowed to use cutscenes and pre-recorded audio.

I agree with this, nearly every game I've brought is from YouTube viewing before hand.

All of the GTA's I've brought, even if I know they're going to be good, I've viewed gameplay/trailers/reviews on YouTube.

 

P.S Yeah communism is often confused with dictatorship.

I tried to monetize two of my videos to release some mods last night and got nothing but under review problems. Its a pain in the ass if you ask me. Even if they stop monetizing game play videos i will still be uploading mods. I hope they don't tho.

Well, there are some guys who are earning a lot of money just for uploading videos of them, just playing a game with a webcam and saying stupid and graceless things (the worst is that they have tons of people following them, hence making them earn more money). But it would be unfair if YT also took down the channels of the people who just upload videos for fun or for helping people and showing the gameplay.

Jay: In a lot of cases, that's doubtful. *Especially* when you are monetizing the video. Copyright infringement isn't actually a crime in the US. Yes, the RIAA and MPAA lied in those ads. It's a *civil* offense; it can only be enforced by the copyright owner filing a lawsuit. However, copyright infringement for profit *is* a criminal offense. You don't just face a lawsuit from the game publisher; youi might find yourself facing your local prosecutor. Going along with that, commercial use of copyrighted content has a much higher bar for "fair use".

People talking about Vimeo: You realize that they would also have to respond to takedown requests, right? It's also a US company, and has to obey US laws. Vimeo doesn't want to be sued any more than Youtube does.

Seriously?! YouTube is banning gaming channels? I've not had any of my LCPDFR videos taken down yet... I don't want it to happen either, but why are they doing so?

In all fairness, people go a little far with the uploading of videos, that have COPYRIGHTED music (such as the bad boys tune) plus people try to portray the game to be as real as possible with a 2 1/2 hour gameplay video like what do you need an near 3 hour gameplay video for? i'm not gonna sit there for 3 hours, MAYBE 10 minutes.. this really doesn't affect me as I really can't be bothered with uploading videos of the same stuff, week in and week out..

Youtube are only going after users whom record videos (unsponsored by any games company, or has special permission, like pewdiepie, nerdcubed and many other gaming channels) and gain monetisation money. Which is in breach of the DMCA as you're gaining money from something you do not necessarily own. You may have bought the game, but you don't own the title, nor have special permission where a little bit of your monetisation money goes to certain game companies. Like how the machinima partnership works, Where machinima's total gross revenue goes to many games companies to keep them happy.

Youtube have the full right to do it, and i think it's justified. But i think it's a bit of a dickish move. But if you post gaming videos without getting money, you're in the clear. But if you gain money from gaming videos without any money going to the publisher. Shit goes down.
