Marine831, I'm going to respond to your scenario and state why you would be in the wrong (again, based on state laws that vary by state). In Florida, for example, I have the legal right to detain you by placing you in handcuffs if I can articulate that I wanted to demobilize you for my safety while I conduct my investigation. Absent my development of probable cause for an arrest within a reasonable amount of time, I would then remove the handcuffs and release you. If you resist my lawful detention I'm going to use all force necessary to arrest you for obstruction of my investigation. If you resist me violently, I'm going to arrest you for resisting with violence and battery on a law enforcement officer.

I don't intend to continue a back and forth argument regarding scenarios with you, but I can tell you don't have a grasp on this concept although you do seem educated to some extent regarding the Constitution. I will agree with you that a badge and gun mean nothing, and I also agree there are cops out there who show disrespect for the public and abuse their authority. They should be fired and/or prosecuted for doing so, but I can tell you individuals who do so are the minority and I don't believe it is fair to attribute that moniker to all of us.

I can also tell you that I follow the Constitution and all laws when performing my duties as a Sheriff's Deputy, and I've never had any problems nor any accusations regarding my conduct on the job. I think that record speaks for itself regarding my ability to stay within my boundaries. I would expect my fellow deputies to do the same, and I'd be the first to correct any behavior of others who work with me (I've done it before).

I don't personally see any problems with CISPA. Unfortunately I think the media and the internet culture are influencing opinions with inaccurate information. I think any measures to strengthen cyber security should be taken especially when it is optional for private companies and websites to send the information back to the government. Theft of intellectual property is a growing problem and attempts should be made to prosecute these criminals. "Civil liberties" and "freedom of speech" don't excuse the illegal act of intellectual property theft or the transmission of property obtained illegally. No where in the amendment to the National Security Act does it state the government is going to spy on emails and/or other forms of personal communication. It more properly defines cyber security and intellectual property theft, and gives remedies to companies and websites (much like LCPDFR) when they are the unfortunate victim of cyber attacks.

What can you do? contact your representative and inform them that you oppose this bill, and that they will not get your vote if they vote for the bill, be nice, chances are you're dealing with a intern, or a low level, possibly volunteer, being abusive won't help you, also close any accounts on websites and/or services mentioned above, also inform them the reason for why you are leaving.

Please note: not every company wants to do harm, some/most are either looking to protect their property, or will make money from the bill.

I don't personally see any problems with CISPA. Unfortunately I think the media and the internet culture are influencing opinions with inaccurate information. I think any measures to strengthen cyber security should be taken especially when it is optional for private companies and websites to send the information back to the government. Theft of intellectual property is a growing problem and attempts should be made to prosecute these criminals. "Civil liberties" and "freedom of speech" don't excuse the illegal act of intellectual property theft or the transmission of property obtained illegally. No where in the amendment to the National Security Act does it state the government is going to spy on emails and/or other forms of personal communication. It more properly defines cyber security and intellectual property theft, and gives remedies to companies and websites (much like LCPDFR) when they are the unfortunate victim of cyber attacks.

But the issue is that that property is too loose, and can be applied to anything. For example, if someone says their face hurts, facebook could charge them for stealing intellectual property. If someone criticizes Fox News, Fox could charge them for using their name. These bills don't stop piracy, they are designed to censor people on the internet.

Basically, if a word is within a name, like face in facebook, then it could be claimed as intellectual property. If someone makes a viewpoint not liked by someone, they could be charged with this law, and it shuts down the first amendment.

That's not true, though. Especially because "Facebook" is a trademark, not a copyright, and trademarks are restricted to where they would cause confusion. Similarly, patents only restrict their actual claims and stuff derived from them; if you take a small part of a claim (like taking the idea of a vacuum cleaner from a patent on a vacuum cleaner improvement), the patent holder has no case. You're thinking of copyrights (which protect small components of the whole work), but they wouldn't apply here, either. This is mostly because saying that using "face" to mean an actual face violates IP is completely retarded.

i find it funny how the goverment is more worried about some nerds on a computer then the murders and rapist roaming the streets day to day.

everyday more and more non volient offenders are sent to jail for petty crimes while when it comes to actual crimes that we should be stopping it goes ignore and side swipped by ^^things more important^^.

What problems could hacking into a bank cause for others? To start, if you make money off it, you're either directly stealing from people or just adding money without taking it from elsewhere. If the former, it's bad. If the latter, it leads to more inflation, and reduces the value of everyone's money. Basically, hacking into a bank is the classic "should be extremely illegal" scenario.

The way laws are designed and the way they're used are two completely different things. I think any police officer will be able to admit that our legal system isn't perfect, and never will be. Your jobs are to enforce the laws, not tell people which ones are right and wrong. Remember that the people behind the enforcement of these laws have to act with discretion and "by the book" usage in mind, and everyone here knows just as well as I do that it won't be that way all the time. I think the majority of the laws we have in place as a country are here for the right reasons and are used properly, but CISPA isn't and won't be one of them. They're attacking this piracy and hacking problem with an axe when they should be using a scalpel. The government can peek in on what you're doing any time they want. All they want to do is make it publicly acknowledged and "okay". We Americans were quick to accept the Patriot Act in the wake of 9/11. Quite frankly, this is nothing but the cyber equivalent of that, and while the intentions of it may be noble, it can be used to stifle innovation and creative content if controlled by the wrong people. There are very few people among the giant crowds of old white men that make up our government house and senate that actually understand technology and how computers work, never mind the course we humans need to take to maintain the integrity of our last truly free market.
