Hey guys so I have just have one simple question do students a.k.a in high school, have rights?

The reason I ask this is because yesterday a student was auguring with the teacher saying it's his civil right to sit in his seat and that she can't make him move because he didn't do anything wrong, she threatened to call the ap and everything but he still would not move out his seat. It was kinda disturbing to see that.

Speaking about rights, if he sits in the university owned chair on university property, it's for proprietor to decide whether to allow him that. Other way it's a trespass... I think.

as for the rights thing, I Was a pretty bad apple in school. not gonna go into details, but fights, cussing, regular Irish People things were the norm for me back in the day..   If that kid wants to Know what it Really feels like to have rights taken in school he should go to a Alternative Placement school (where they round up all the bad kids and take them away from the kids who are there to learn full of "gangs" and all of that) 

 

Just to give a little taste as to what its like there.

 

You are never left alone, Never.. If you need to go to the bathroom you have to ask the teacher who gets an administrator to take you and go with you to make sure you wont do anything or smoke anything  (Keep in mind this was In the Middle School Grades 6th-8th)

 

Its Fenced off on 3 Sides excluding the Entrance to the parking lot (I've seen some kids Run away from the school only to get caught by the Local police (Station close by) 

 

They try to keep the Students as far away from each other as possible there is no regular lunch or cafeteria we ate in our classrooms

 

If you didn't want to get your seat moved or back talk to the teacher in any way, automatic week of suspension 

 

Feeling a bit Chippy? want to Call another student out? that will be an automatic week of suspension No Talking it out

 

It feels pretty much like a prison school and looks like one too we had police at that school everyday with Weekly Drug Dog Checks

where they take the dog and run it up and down the halls checking Kids, Lockers, Etc

 

 

Luckily after my experience at that school i Finally Acted of age and decided that fighting wasn't going to get me anywhere in life..

But if you actually know that guy, make sure to tell him this and ask him if he really feels that his rights are being violated that badly

cause it can get a whole lot worse

sitting in a seat isn't a right. Respect the teacher. Sounds like somebody is just trying to start a fight with the teacher

Love it when people say they know their rights because the majority of them have not studied any law or have even read the Bill of Rights. Most people are just going off of what they heard from a friend, saw on Youtube, read on some BS website, or saw on TV/in the movies. I spent 4+ years studying the Florida State Statute book and loads of case law so I probably know your rights better than you and can tell you what law you broke. I can't count how many times I've heard "but on Cops they did it this way" or "but on one episode of Law & Order", those are TV shows and mean nothing when it comes to what the law actually is. It doesn't stop with laws either, when you are processing a crime scene and the caller starts barking off what they need dusted for prints or something like that because they saw it done on [insert forensic TV show], they get pretty pissed when you try to explain that you can't dust for prints on a wet surface or that not everything they do on CSI is real. And for the people who try to pull the "I pay your salary!" shit, here is 10 cents you can keep the change.

 

The ignorance is astonishing sometimes.

 

As for the answer to your question. Obviously you have certain rights in school but sitting in a certain seat is not one of them.

I meant in response to the kid the OP was talking about. If the kid doesn't want to move seats just because he likes his seat then too bad, you don't have a right to that seat.

Yes, students do have rights. Teachers work for students. If there were no students, then teachers would be out of the job. You could say the same for students, but most high school students don't have bills they need to pay.

Yes, but I doubt that teachers chose their job just for the money, especially in America. Every teacher I've talked to, chose to be a teacher because they love to work with students. They love sharing their knowledge, and assisting others in mastering that same knowledge. Then when the students take a test and pass, it makes the teacher feel great. The fact that they taught something to someone, and that person understood and mastered it. If no students, not a single person, showed up to school, what money would the teachers be making? I wouldn't want to pay someone for sitting in an empty room doing nothing. Not only would they be getting paid for nothing, but they'd probably be disappointed that nobody's come to hear and accept their knowledge. 

 

Without students teachers would be virtually, jobless.

At my district you get charged with truancy if you go a number of days without going to school.

Your rights are set by court precedent. I believe Tinker v Des Moines, stated they are still allowed their civil rights, but a court precedent stated that it may not interfere with educational atmosphere. Also schools don't need probable cause. They only need reasonable suspicion. There is no Student Bill of Rights.

But in your case, That student was a dumb ass. It's school property. But that's beside the point. What was he hoping to prove by defying the teacher? People like that piss me off.

yeah one other thing i can't stand is when teachers threaten to call their parents or the AP and the students respond 'so i don't care i'm not scared of you' like dude that wanse't meant to scare you.  :pirate:
