Kidnapping question

So I have a question, when a person is convicted of kidnapping, what is the max amount of time you can get if found guilty of kidnapping?

Oh by the way, I live in the us.

Any who, I have absolutely no ides.

Plus, it would differ from Country to Country and from State to State, so if you want a definite answer you would need to be more specific.

At least, under U.S. Code, section 1201, the punishment is as following:

shall be punished by imprisonment for any term of years or for life and, if the death of any person results, shall be punished by death or life imprisonment.

If it's in Singapore, if the kidnapping suspect is found guilty, he will be sentenced to death... I am not kidding... That's why the kidnapping rate here is so low....

I'm guessing between 8-15 years(minimum), they bump it up if firearms were at the scene. Also if they're children involved, they might add additional charge such as child abuse or maybe child endangerment. Also ransom and possbly

sexual abuse/assault

Your an odd one.. you must be gamerdangers brother or something or long lost cousin lol jk but seriously, why would you even ask that without reasoning as to why?

Okay, let's start with no I did not kidnap anyone, I'm not a psychopath if that's what y'all are thinking, and second the reason I ask this was because I watched a tv show, and it mentioned something like this. There now do you understand? Lol.

I hope that tv show isnt "How to kidnap someone"

Oh trust me, it's not, I would never watch a show that encourages criminal violence.

Here in Brazil, if it's ''just'' kidnapping (no money on it) it is about 6 year (without aggravating as: children, elderly etc.) and if it was a extortion through kidnapping its arround 8 at 15 years. (bad english)

US federal sentencing is generally determined by the US Sentencing Guidelines (they aren't *binding* [they're developed by a sentencing commission, not directly enacted by Congress], judges can deviate from them if they so choose [as opposed to rules directly enacted by Congress, such as mandatory minimums], but they're normally followed). You can try calculating things for yourself at the (unofficial, not legal advice) website http://sentencing.us -- there, you'll find that kidnapping has a base level of 32, meaning that even with no criminal history and no aggravating factors you're facing 10-12 years in federal prison, meaning you'll serve at least 8 years 9 months if you get time off for good behavior (federal prisons take time off your sentence for good behavior, so you might serve as little as 87% of your sentence, but there is no federal parole anymore, so you don't have that shortening a sentence).

Things like using a weapon, making ransom demands, keeping the victim longer than 7 days, seriously injuring the victim, etc. all increase the sentence. If you murder the victim, the sentence rises, under the guidelines, to life in prison (or possibly death, the guidelines don't cover death sentences). However, if you murder the victim during a kidnapping, it'd probably be charged as first-degree murder (instead of kidnapping with a murder enhancement), and federal courts are required to sentence those convicted of first-degree murder to either death or life in prison (that's set by act of Congress, not in the sentencing guidelines), unless the government specifically asks for a shorter sentence because you were helping them (e.g. you're a low-level mobster and help the cops convict the boss).

It depends on a tonne of factors - weapon involved? How long was the kidnapping? What condition was the victim in? (Injuries, starving, etc.) Is the victim even alive?

Why not search it on google? Not that difficult...

So you're more than willing to ask a company that sells your information (including what you put in the search box) what the sentencing for kidnapping is?

Honestly, I'd run it through something that didn't track me (like DuckDuckGo) but a lot of information you can get about illicit activities (say you're writing a novel and want to know how much a kidnapper makes in a year) you can get off of HavocScope.

I ran a check and didn't find anything about sentencing, though.

As someone posted above, they must follow guidelines to sentencing. If I recall correctly, for most crimes there is a "range" of time to be served, left to the presiding judge's discretion. Depending on the charges the prosecutor presses, there may be an absolute minimum the judge must give you that is set by the commission. That is normally reserved for more heinous crimes and/or repeat offenses.

Although it's HIGHLY unlikely that you'd serve the full sentence unless the circumstances are incredibly heinous, or you're a repeat offender. Depending on the stipulations of your sentence, you may get 1.5 days served for every actual day you're incarcerated, or you can "work" to get time shaved off, or like mentioned above for good time. Or the fact that our prison facilities are a complete joke and overcrowding is more than an issue and we'll parole you as long as we're sure you won't put a knife in a guys neck just for looking at you wrong.
