I can't understand the argument of "I don’t have nothing to hide, I'll let them grab and search in my phone". There’s a basic right which is the right to privacy, just because you don’t have nothing to hide would you let Government install surveillance cameras in your house? Things have to be kept legal, which is why there are search warrants. Although I can imagine that many on this site would disagree, police should not be all-powerful but work under the limits of law and constitutional (may vary depending on the country) rights, unless you want to end up dealing with a gestapo alike police.

    Back in the day when the only warrant you needed was a badge, gun, and a foot to the door. Back when murders, rapists, molesters, ect. were looked aside from, so they could get a little one on one jus

Well, if someone has no problems with showing cops their cell... Just show it them! Do not force other people do the same. I generally like police, so I would help them in any way, including showing my phone and answering their questions, but that's my decision, not a legal requirement. An officer must have either a probable cause (and a real one) or a court issued warrant to forcefully invade other people privacy. 

 

If an officers knows the guy is on the line with his dealer right now, he definitely can take a look at the number. If an officer is in a bad mood, he sees a guy and says 'Gimme your ID and ur cell, I wanna check if you've been calling Usama', I don't appreciate that. 

 

In other case, like Strike said, why would we need search warrants at all? 

"Harass you for nothing" I really dont think that they could harass you more with your ID than without. I'd just respect the cop's job, not waste time, and just give him your ID. If you've done nothing wrong; why not give your ID? Unless your lazy as F#&k that shouldn't be an issue. I dont want to turn this into an argument, but I would really like some more feedback.

There is no reason at all to turn this into an argument, we can sit here all day discussing why I'm not about to have my rights violated,  FYI they can't legally ask you for ID unless you have broken the law, but again, they do, also, what does being lazy have to do with me not producing my ID?

I just don't understand where people think they get off "If you've done nothing wrong, then whats the problem?" it's all about my rights & the fact that is says so in the Canadian Charter Of Rights, unless I'm suspected of breaking the law there is no need of an interaction with an LEO, plain & simple, If you want to give up your rights that's up to you, but not everyone feels that way, give them an inch & they will take a mile.

Why I Approve : The Chance to have a cop seeing your nude photos of you and your girl and other personal Chats.. Zero ! :)

 

Why I Disprove : Well If the phone was use in a crime such as Recording a Crime Like someone getting Killed , Raped , Kidnapped and so on! which happens alot and leak on the internet . Well Sorry Cops That victim will have to wait till the Warrant Comes thru!

There been so many crimes rising more people getting away with crazy crimes such as rape , murder , Internet Crimes , and ETC. and Once thing I learn in Criminal Justice. Interesting debate this and I have mixed opinions.

 

I personally don't care if all my personal data is being reviewed by law enforcement how-ever I respect the onions of others who do (Whether I'm in the U.K. or U.S., all though definitely not countries plagued with corruption (Yes I know the U.K. and U.S. does have corruption, but it's not on such a scale as others) - but that's another debate for another time). 

Either way, if you're suspected of something serious which requires your personal data being looked through on your 'cell' phone, then it shouldn't be too much of a problem getting a warrant, it just won't be an on the spot search through your phone, it'll be done at a later date (And the data won't be deleted because it'll be kept in a secure location). 

 

In conclusion, I'd be happy to show my phone to law enforcement, and for those who don't, then it's your choice and unless you're suspected of something serious, then it won't be searched, if you are how-ever then they can just get a warrant by presenting their evidence of why you're suspected of something serious. 

I disagree. I don't have anything suspicious in my mobile phone yet I wouldn't want a stranger to look at my stuff wether he's a civilian or a cop. That's why the judicially issued search warrants are.

 

Let's say you are walking down the middle of the street and a cop says randomly says that you are wearing a bomb under your clothes. Would you simply undress "because you have nothing to hide"?

If you are not hiding anything why would you care so what if they see that you bought a new TV or something

I think people are having a hard time understanding it's not about hiding stuff, it's about the right to privacy, which we are entitled too 100% but the government spies on us in a way that they say deems it okay, I'm sure there are a few cops on this site just here modding reading this stuff & haven't said anything because it's true, no one wants their rights violated in which they were entitled to, I recently started reading the Canadian Charter Of Rights & it's definitely good to know your rights against the THUG type of cops, there is definitely 2 types of cops.

 

EDIT: You can like them all you want, but giving up your rights at any time is just plain dumb, what if they found something you forgot about?

Half of the searches & stops done by the Police on the show COPS is not legal.

Well im not that type of guy who is going be uncooperative 24/7 like you. the the other thing is i dont care what they know about me. If they find out that im moving to a new house or something who cares.I like the police so im going to be cooperative with them and not be a pain in the butt

Personally, i've been on dozens of ride alongs with my local pd, and I have never seen a case where they have needed to search a phone. So honestly, I don't think this is a big deal at all.

Im not like you. I will never be like you. You are the guy thats yells "YOU NEED THIS BEFORE YOU CAN DO THIS TO ME" thus making their jobs a tiny bit harder then it already is. Im the kind of guy that is going to let do what they need to to and they wont need a warrant if they need to search my phone. I dont care if they see who i talk to or what i do on my phone. If you've got nothing illegal to hide, why does it matter if they search your phone? What privacy do you need if you've been obeying the law? I doubt an officer is going to care about you breaking up with that girl, and that guy buying two Chipotle burrito bowls.

 

Then let the government come into your house when ever they want to look around then...I mean, you have nothing to hide right!  Let them pat you down on the street then, whenever they want to...you have nothing to hide right!  Let the government into your computer or webcam to watch you, just because they want to...you have nothing to hide right.  This argument is absurde on it's face and a lazy mans argument and the argument of a oppressive government.

Once again, you're misunderstanding what I'm saying. Before starting an entire argument, at least try to attempt to comprehend my argument. I never said that the government should be able to run up inside of my house and search everything. I did say that I'm a bit confused as to why the Police need a warrant TO SEARCH YOUR CELL PHONE. I'm not understanding why people are mixing a CELL PHONE warrant with a HOUSE warrant.

I don't think it's fair to call people ignorant for thinking that the Police shouldn't need a warrant. I feel that you're attempting to turn an opinion, into a written fact. I have had, in the past, an officer ask to look at my phone. I was nearby an ongoing incident in which the police were searching for a suspect of which they knew the name of. The officer asked, I had nothing to hide, so I gave him it. He showed me the screen while he was looking through it and only had a glance at the top message and the last couple of phone calls made. He then asked where I had come from and where I was going and then sent me on my way. I did not see a problem with this and I still do not.

I posted a quote above in response to your argument. Americans think that they're all set. They have their rights, the government protects them. Everything is all happy and well. The government is taking our rights away, and most Americans don't even know it. The government doesn't care about our rights. It's all Amercan propaganda, and American citizens are drowning in it.This can start an entire separate debate from this topic, so to keep from going off topic I won't get into this particular argument any deeper. 

 

I didn't say you did compare a cell phone warrant to a house warrant. I was just requesting that you don't. Everyone seems to be comparing searching a cell phone, to searching a home. They aren't the same and I'm not talking about searching a home.
