I always thought firearms just fired blank rounds like they would a regular round, I didn't know that they made specific blank firing ones. I suppose they could own a cap gun, but (in the US) those have to have an orange tip on them.

Depends on what state and what kind of felony.  If a federal offense, I believe that is a big fat NO.  If a State charge, maybe.

While I highly advise against relying solely on any posts on this site, guns are modified to fire blanks, but they can be modified back, which would cause an issue and most likely prevent a felon from legally possessing one. Some things a felon could own for self defense (depending on state of course) are a crossbow, Airsoft guns, baseball bats, or paintball guns.

But a capgun.. It does project anything..the definition for firearms is A weapon, especially a pistol or rifle, capable of firing a projectile and using an explosive charge as a propellant and it doesn't propel anything.. so

I was about to say something about the legality of starter pistols, but on second thought, ASK A LAWYER. If you have specific legal questions, especially those where a wrong answer sends you to prison, ask a lawyer who is licensed to practice in your district.

Can felons posses blank firing guns? They are not real firearms and cannot be converted to shoot projectiles. Under federal law a firearms is considered to be anything that shoots projectiles. 

 

No felon can own a weapon, or have a weapon in the same house/vehicle he is in. If the gun can be modified in anyway to shoot actual bullets (which most just require a barrel change) (s)he can not own it. 

 

 

 

Now for the BB gun part and air-rifles it changes from state to state. In Wisconsin bb guns aren't considered firearms. "

So just look up in your state and see if air-rifles are considered fire arms, so if it is considered a fire arm then no felons can not own one.

 

I don't know where I got that BB gun part I thought someone asked about it woops. But the blank-fire gun falls under the same as the BB gun it depends on the state you live in.

 

 

Also a felony is a felony, doesnt matter what the classification of the felony was its still a felony and you are all treated the same . All felons are prohibited from owning fire-arms from federal law. So its not state to state, this is a federal law that every state goes by.

Felons are still people and should not be isolated. The american justice system is not perfect. There are way too many people who are felons that shouldn't be, Myself for one.  People must not forget that a felon doesn't have to take part in a crime to become a felon. And most black people are giving felonies just to keep them from going forward in their life. I am not going to let any one tell me that because of one mistake I am just as good as dead. Nothing is impossible.

I.E.  blank firing pistols cannot fire live ammo. They stop selling those pistols years ago. From my research blank pistols are ATF  approved and cannot be converted most sellers tell you their policy. If you dont need to get a background check for it then its fine.

My lawyer told me that a piece of metal that doesn't shoot live rounds isn't a firearm. If it was You would need a background check.

No. You did not "accidentally" use a bb gun. You picked it up, to use it.

It may have "accidentally" (as in not intended) fired, but you still knowingly picked it up.

I'm sorry, with this level of responsibility, I would say you should not own any kind of firearm.

Here's the thing: If you think it isn't considered a firearm, and you're wrong, you go to prison. Ask a lawyer. Seriously. The only thing you should rely on for this is legal advice from a lawyer in your jurisdiction. Unlike anyone here, they actually have legal expertise AND have an attorney-client relationship wit you.

A gun designed to fire blanks is not a modified firearm.

You cannot modify a blank firing gun to fire live rounds any more than you can convert an airsoft gun to do so.

It was an automatic bb gun they are designed to fire more than one round with a single trigger pull. Also I didnt just pick it up and used it. The kid was playing with it he found it in my room where I kept it I took it from him and went to ensure that it was in safety mode(which it wasnt) And I put it in safety mode assuming the kid had left my room clicked the trigger and it fired of the kid was still there with his back turned He dropped my puppy so I suppose he was playing it before the gun went off. I have two children of my own and never had a history of child abuse or hurting people, so why would I start at the age of 21? bullshit.
