Do you expect the officer to know that it is a BB gun?? Anything without an orange tip may or may not be a real gun. You cannot take a chance like that. Do I agree with the officers decision? No, but the officer did not know it was a BB gun.

A bit off topic... but one day, some woman called the Police on me and some friends when we were airsofting in our front yard...she called it in as a robbery. Only one officer came and talked to us and asked us to go to the back yard.

From what I understand, the kid refused to drop the weapon after multiple requests from deputies although it is common sense to drop whatever firearm you are carrying, even if its an imitation and raise your hands to show the officers that you aren't attempting to put their lives in danger through your actions.

If I was playing paintball with some friends in a wooded area and some cops come roaring up to us, first thing I'd do is drop the guns to show I mean no malicious intent with them, no matter how real or fake they look.

Please don't take this as literal evidence to shoot a child, I've only just heard of this and I'm reading into it. Will update my post accordingly

I see your point ill recheck, Thanks for correcting me

Bottom line the  kid got what he deserved   he refused to drop the gun or obey the cop's commands

the kid was warned  back up even had time to get there and the kid still didn't drop it or listen to the cop's

no1 to blame except the kid himself   so yeah shooting the kid was right   also had what appeared to be a hand gun in his wasteband

From what I read they just shot him..

im so happy today I have had a few topics where people posted a good bit...doesn't happen on myold account

read this  http://xfinity.comcast.net/articles/news-national/20131023/US--Deputies.Shoot.13-Year-Old/

they warned him more than serveral time's  and it was long enough  where back up had a chance to arrive

that's more than a fair chance to comply with what he cops were telling him to do and  he just flat out refused to listen to the cops which is why he got shot

also it sound's like they didn't shoot to kill and they tried saving the kid right away just wasn't enough by the time paramedic's got there

@ Michael v.  right ?   and why the hell knowing it look exactly real was he just casualy strolling down the street with it

I would like the to this story because I have a feeling your not telling us everything...

And what do you know, you werent telling us everything:

"California sheriff's deputies have shot and killed a 13-year-old boy after repeatedly telling him to drop what turned out to be a replica assault rifle, sheriff's officials and family members said."

He was perfectly justified in shooting the kid, doesnt matter if it has a orange tip on it or not. You can buy orange tips for any gun out there or you could just spray paint it...

It's ironic that this happened because we just talked about this in my issues of law in society class today.

For any situation involving a weapon in most states, the range in which it is acceptable to discharge your firearm in self defense is 30 feet. It used to be 25 feet but they lengthened it because some individuals can close that gap rather quickly. An airsoft gun like the one used here would count as a weapon of this magnitude. If the officer felt threatened in anyway, whether they order them to drop the weapon or not, they are able to act on that threat. If they feel the suspect may use that weapon against others in the community, they are allowed to defend themselves and the others in the way that they did. Interestingly enough, the same 30 foot rule applies to fights as well though usually pepper spray or tasers are used in fights.

Looking from the officers' perspective I can see how they would be justified in this shooting. While it is unfortunate that it was a 13 year old boy, he allegedly ignored multiple instructions to drop the weapon. As he also removed the orange tip from his airsoft gun, which is illegal, it only increased the threat perceived by the officers. The thing I'm most worried about is when people begin to spray the tips of their actual firearms orange. That is when things would end badly.

what in the sweet hell was the kid doing walking around with a BB Gun anyway? he's 13!!1 my parents would have NEVER let me go out with it at that age let alone having one in the first place. and obviously they had good reason to not let me. also he cut the orange tip off obviously.. meaning that he was definitely looking for trouble. and just speculation but judging from that scene photo this incident happened during sometime near sundown.. im sorry but I've never seen anything good coming out of a 13 year old being out and about at night with a AK47 BB Gun with the orange tip cut off.. no wonder he got shot he should have known better.. just my opinion which is a pretty harsh but truthful one if you got butthurt by it I don't apologize. I know the kids parent must feel bad and they should because their the reason why their son's dead plain and simple in this case.. if I was the kids father I would have never let that happen

Well no, shooting a 13 year old boy is never right nor is it what he deserved, it was a foolish choice he made, and that was not to listen and he paid the price & now that cop has to live with that for the rest of his life & I bet he regrets his decision, though I applaud the Officer for holding the boy accountable for his actions, he could have just tazed him, kids don't know the seriousness of stuff like that.
