Quick question for LEO's

Has anyone watched Tom Zebra on youtube? Why is it that he can call officers F**king Pigs & B**ches and why do they tolerate it? Can they not do him for harassment or verbal abuse? Because i tell you this if i called a local cop a b**ch let alone a f**king pig, firstly I'm probably getting my front teeth knocked in lol **joke** but I am definitely getting slapped in cuffs and literally thrown into the back of a paddy wagon not joking there :tongue:

But in all honestly they have the patience of angels because I wouldn't tolerate it.

because that is a right guaranteed by the first amendment. Im not a lawyer or an expert (or a cop), but from my limited knowledge, as long as he isnt threatening anyone, he can call them whatever he wants.

But its so repetitive it surely has to be harassment, every second word is abuse

Because it is a first amendment right.  I'm a Police Reserve Officer IRL.  We have the same power a full time officer does, we are just volunteers is the only difference.  We can usually find another reason to arrest you though if we really wanted to be dicks.  Walking in the roadway alone is arrestable in my state unless a sidewalk isn't available.

OfficerFive0 is correct.  Even if the person is screaming at you and saying the worst things imaginable, it's still Freedom of Speech.  If there was someone following the officer to his work, to his home, to a call, etc, that would be considered harassment.

 

That's one part of being a cop that most people are too ignorant to understand.  Cops tend to have shorter fuses because of the garbage they get called, because of the things said to them, etc.  (along with the things they see and experience)

 Garda reserves cannot make an arrest without a fultime garda present here I believe, and If walking on a roadway is an arrestable offence you would hate to be here of a thursday night through to saturday night lol

This Tom Zebra idiot encounters a LAPD officer and if he doesn't like the way they act/speak towards them he will follow them through their whole duty recording them. Obviously has nothing better to be doing.

I see all these people on YouTube out looking for trouble and using there constitutional rights against officers and I believe in constitutions but when they are literally out looking for trouble its not right or fair on the officer having to stand there while he could be doing something useful while all the people recording are only worrying about is how many views this on will get on YouTube

Along with raising their voice and making threats, then you can be arrested for obstruction or disturbance.  Here is the exact law in writting that backs that up at least in my state and most other states

 

"If any person shall willfully or maliciously disturb, either by day or night, the peace and quiet of any city of the first class, town, village, neighborhood, family or person by loud or unusual noise, or by abusive, violent, obscene or profane language, whether addressed to the party so disturbed or some other person, or by threatening to kill, do bodily harm or injury, destroy property, fight, or by quarreling or challenging to fight, or fighting, or shooting off any firearms, or brandishing the same, or by running any horse at unusual speed along any street, alley, highway or public road, he shall be deemed guilty of a misdemeanor, and, on conviction thereof, shall be fined in any sum not to exceed One Hundred Dollars ($100.00), or by imprisonment in the county jail not to exceed thirty (30) days, or by both such fine and imprisonment, at the discretion of the court or jury trying the same."

That's how our world is now.  Everyone jumps at the chance to attack a police officer's character and to make him out the bad guy.  It's why we see the news littered with "cop shoots black kid", "cops plant drugs", "cops enter home without warrants."  You NEVER see the positives in the news because it doesn't incite riots. It doesn't incite violence or controversy.  We live in an era and a culture where it's much more fun to whip out our phone and watch someone get beat to death than to try and save their life or at least call 911.

It is simple.  There is bigger fish to fry.

Visit me on youtube. The most common reason for crashing is user error. Make sure you have the latest RAGE, ScripthookV, ScripthookVdotnet and turn off your antivirus. Make sure you have an up to date gameconfig.xml as well. Use Allbo's plugin troubleshooter to find any errors too.

That's is true, its absolutely ridiculous. I just don't understand people sometimes. 80% of the people on YouTube get arrested and the outcome is never revealed so Im presuming (hoping) that it didn't end as well as they thought it would.

Whats this other one I have been watching where on traffic stops they tell the police they are not driving, they are travelling which doesn't require a licence and so on? If they are behind the wheel and the vehicle is moving then they are bloody driving in my opinion lol

That's stupidity and everyone knows it. They know they need a license, they are just hoping the officer is stupid and lets them off.  Those people should be slapped with a hefty stupidity fine.

No, because I do not live in California.  That is a law in my state, but not theirs.  Their laws may be a bit different but I'm sure they have a similar law.

They should be taken to jail actually for failure to provide documentation and obstruction. lol

@Kallus Rourke I seen one fella, not sure of the state but he had no licence or registration and the cop left him off with a warning. If i find the video i will link it.

On another video a fella tried the "Only pull the window down an inch or two trick" the officer told him pull down the window and the driver refused so the officer put his two hands on the window and pulled it clean out. Ill link the video below, skip to 2:00. Its absolutely amazing :tongue::tongue:

We have an administrative offence called "Petty Disturbance", and if you swear in public, there's a perfectly valid cause to detain you.

 

However, in Russian we have those words that are considered profanities. Simply saying "shit", "damn", "fool" in public is not an offence. Something like "fuck" and such is. To my knowledge English has no such clear distinction...

Citizens are protected (to an extent) by their first amendment rights to insult police officers without legal rebuttal, but aren't police officers also protected under the first amendment to respond freely?

 

Of course, an officer responding to a verbally aggressive individual could escalate the situation and it can be considered unprofessional, but legally speaking, shouldn't they be allowed to respond?

No.  Officers have the right to respond, but not from their employer.  This goes for any occupation.  You can respond to someone talking bad to you, but how you respond can mean the end of your career.  So yes, officers can respond to verbal aggression, but if it's anything other than "okay sir", "please calm down" or anything that would be defusing the situation, his job is most likely on the line.
