There are plenty of videos online of people driving through border checkpoints and refusing to show identification or give consent to searches. Typically, I'm against these stops because they're unconstitutional, and unfairly target minorities (in the case of citizenship checkpoints in the south). But I think there should be exceptions for certain circumstances. California, for example, has (or has had) a big problem with invasive species. 

 

I've fast forwarded to the relevant part. Watch as a constitutional advocate goes off on a border protection officer upon entering California. Note: This stop is not a citizenship check. Its a check to make sure invasive species aren't being brought in by unwanted fruits and firewood.

Im sorry, I just want to ask this, how are/do these "unconstitutional, and unfairly target minorities" I do agree with these. Billy was very good at handling this, and these guys are complete idiots, they don't even deserve a YouTube Channel.  I hate people like this.......This person, too me should be jailed.

Some border checkpoints are put in place to stop supposed undocumented immigrants, but what ends up happening is Hispanic people are singled out and searched for no reason other than the fact that they're Hispanic. Compare the border security at the Mexican border to that at the Canadian border....

I think these "fruit checkpoints" are totally fine. They're helping keep our environment safe.

Well it's completely legal. CBP/DHS has every legal right to search you without a warrant or probable cause. In this video, that person wasn't even CBP. 

 

So essentially, you posted a video that is almost in no way related to border searches, just so you can complain about border searches?

I made it very clear that I think this stop is totally fine, but said there are some ethical and constitutional problems with other kinds of searches. So if you're going to completely ignore the OP and start a needless debate, please stop.

I'm totally OK with a conversation or a debate about border checkpoints, so I put my opinion as a disclaimer. You just completely misunderstood the main point of the thread. I'm not "cop-bashing". It is entirely possible to have a lighthearted conversation about a serious issue, and laugh at a funny officer's reaction without having a huge angry debate. Keep it civil.

​Exactly haha. When the founding fathers wrote the constitution, I don't think they were talking about fruit checkpoints. People are so caught up in defending their rights that they seem to forget why they have them in the first place.

I know it's a silly concept, and he seems rude, but damn it read your Constitution and Bill of Rights. When these things go, so will your freedoms. The word "Constitution" has become the new "N" word that people dare not say. When the government comes knocking, you people flail on the floor screaming like frightened children. Stand up for yourselves, and others. Regardless of what you say, these checkpoints ARE illegal. People cannot stop you and search you without probable cause... PERIOD. You cannot make a law that goes against the Constitution, or goes against another law. But I'm informed so I'll be made out to be the bad guy here and somehow racist. These aren't Illegal, these are protecting all of your lives, Protecting your town/city/state from dangerous bugs..Many things. (Going into Checkpoints information) Nothing is illegal with DUI Checkpoints, Checkpoints happening anywhere right now. Your rights state and I will continue to quote "

The Fourth Amendment (Amendment IV) to the United States Constitution is the part of the Bill of Rights that prohibits unreasonable searches and seizures and requires any warrant to be judicially sanctioned and supported by probable cause." Checkpoint searches are reasonable. At checkpoints, they may take anything they find illegal, I.E. Weapons, or in this case bad fruit and or firewood. This checkpoint is judicially sanctioned and is supported by probable cause because they are checking for bad fruit.

There's a fundamental difference between "There is terrorism in the world, so we have to collect all of your data", and "some beetles are devastating our environment, lets make sure people aren't bringing in firewood".

Nope, nope, nope. There are a number of exceptions to the Fourth Amendment. One exception is for border searches; customs has the authority to do routine searches without warrant or any cause for suspicion whatsoever at an international border. There are others, like searches incident to arrest, exigent circumstances (which includes Terry stops), and objects in plain view.
