THAT WAS IT!!!! Its working now!!!! OMG what a haedache! well if any one has my same issue at least we have the ground work done... now before I go to far ''and mess up again'' how do I make the ''right'' game back up?

    You need to delete the update.rpf in the mods folder, and copy over the vanilla update.rpf like you did the first time when you made the mods folder.

    Yes, in OpenIV go into mods-->update.  Delete the update.rpf folder within.   Next, go back to the main directory in OpenIV and go into your vanilla update folder.  Right click the update

You must be on an older version if downloading it worked for you.   The "right" way would be having a second directory to back up everything.  However, that's not entirely feasible.  The best way to back up your game is this method

After all that work I am a ''dummy'' It was my car mods in IV that broke with the update... since I cant seem to get ELS to work I used a ELS inspired mod that came with a ''IV installer'' this is what was breaking my game >.< I figure it out just now as every thing was checked and double checked... and back ups made then I reinstalled my car mods and BOOM broke again... Unistall the car mods fixed! ....uggg >.< 

This was the one that was breaking my game ''which is sad because  it was the only on I could get to work'' >.<
