The iPhone 5 shouldn't be $400 with a new contract unless you get the 32 or 64gb model or something like that. A 16 should be $200 with a new contract. The OS isn't what makes the iPhone 5 a lot better. It's faster, has a bigger screen, it's thinner, better graphics chip, better battery life generally, better camera, has 4G LTE internet speeds which is a significant upgrade by itself, more durable due to the new Gorilla Glass 2, Thunderbolt port, and it will support iOS 7 where as the 4s may or may not.

The way I see it, you have a 2 year contract to go through, so you should get the best phone you can so you can milk its resources and not be disappointed after only one year of us. My phone still has a couple of advantages over the iPhone 5, and it will be 1 year old in November. I can renew next August/September.
