Thanks for the comment's everyone I do appreciate them. I have been harassed by the police. For having the push-bars and antennas on it. In Ontario the vehicle can be seized if I impersonate a police officer or put decals on the car to make it say police. So when the officer pulled me over. They ended up having three cruisers show up. There are a few of these black and whites in the city where I live btw. So there try to intimidate for the antennas and such. Now mind you these were city cops. The car is a ex Provincial Police car, much like the CHP. I have never ever had a problem with the OPP while driving this car. They have been directly beside me, across the street from me and I've own the car for over a year. But the city cops had a problem with it. I explained that to the officer with the city and he replied "that's because they think its a real cruiser". To my reply, "Oh come on, do you think they're that stupid that the can't tell the difference". He didn't say anything after that. I said "I know the law and if the vehicle looks has the markings of a police vehicle you can seize the vehicle. So seize it". They said "no we aren't going to seize it". And I replied "well if it looks so much like a OPP cruiser then you are required by law to seize it". Again they replied "No". See just like anything when you tell a person to do something especially the police but I find that for most cases people wont do it. Because they don't like to be told there job. And for another, they knew I was right.
So they went back to their cruisers and I want you to take not of this part. The officer who made the initial stop was driving a Crown Victoria. The officer came came back and handed me a ticket, now get this. For no "mud guards". I said "you've got to be joking"? He said "my vehicle under the Highway Traffic Act (HTA) doesn't comply". So as we were bantering back and fourth I pointed out look at all these cars going by without them. He stated "I write everyone a ticket for this". I said "come on. You can't be serious"? He was. The fine was $160. I was shocked. He walked back to his patrol car and I was sitting there with the ticket in had and I thought, wait I wonder if his Crown Victoria has mud flaps? I get out of the car and him and his partner spring out of the cruisers. I asked "Are police vehicles exempt from such a law"? He said "I believe so". He had no damn idea. So I walked back to his cruiser and said "your car doesn't have them. I guess its a double standard eh"? He didn't say anything and from here on in I decided that he will forever be know as officer Mudflap. Even if he reaches the rank of chief. He will be chief Mudflap. With all do respect of course.
There were three options on the ticket, pay it; speak to the prosecutor; or go to trial. So I opted for #2. Speak to the prosecutor. I read the law under the HTA section 66(3)
Mudguards
(3) Every motor vehicle and every trailer shall be equipped with mudguards or fenders or other device adequate to reduce effectively the wheel spray or splash of water from the roadway to the rear thereof, unless adequate protection is afforded by the body of the motor vehicle or trailer or by a trailer drawn by the motor vehicle. R.S.O. 1990, c. H.8, s. 66 (3).
I figured I had an airtight case. First the officer's cruiser didn't have them. The police weren't exempt from the law. And the vehicle past a safety inspection by a licensed mechanic. As well there are no specific dimensions at to what are adequate or inadequate protection for a vehicle. I had them dead to rights.
I receive my date to meet with the prosecutor. A day before my birthday. I go to court meet with the prosecutor and she asks why I don't want to pay the fine. I said "first off the police car didn't have them, why should I"? Now this is priceless her response. "Your vehicle is not a police car". "I know this I said, I have the exact same car as the police car" Again "You do not have a police car". "Well how do I go about giving the police officer a ticket for driving a vehicle without mudguards". She said "if you want you can file a complaint with the police". So this went back and fourth and she said "you don't have mudflaps". I was getting pissed off now. "How then could my car pass a safety and the millions of other vehicles on the road"? She gave me a stupid answer and then reverted back to her previous statement "that I didn't have mudflaps" and then she flips a page and she had the officers notes. And on it stated that "It looked like a police car". But yet earlier if you remember she said "It wasn't a police car". AND THAT WAS THE WHOLE ISSUE! POINT BLANK! So I was just so pissed I gave up. She said so your two options are to pay it or go to trial. My aunt was sick I am going through with hell with that and I just said "I'll plead guilty and pay it". I had to then go into the court in front of a bunch or red light camera ticket offenders and plead my guilt before a judge. When the judge read the charge you could just see the look of WTF is this charge.
In hind site, I wondered to myself what had transpired and how I could have handled that differently with the prosecutor. I wondered to myself, I bet she doesn't have mud guards on her vehicle. The hypocrisy of it all. I know its a minor infraction, but just think how the law can screw you. And this is why we have lawyers people. For crap like this. It doesn't matter that the police is above the law or anyone else for that matter. Just that I got "caught". I have never ever felt so cheated and railroaded in my life. I let the issue rest for a while. Made a joke out of it. Then I contacted the Chief of Police. He was put me in contact with his executive officer. We've been playing phone tag, but I'm sure I'll get the same cavalier attitude that they are the law and I'm wrong.
That's the story so far
So as to comment to the post about harassment or being attacked by the public. The public is the least of my worries. The police are the issue. I have stripped the car of antennas and push bar and it is exactly how you see it. It's a great car to drive. Handles like a dream and have more get up and go then my 2008 Bullitt Mustang 4.6L 3V. And is not to bad on gas for a V8. The headliner is typical of North American cars. Pictures to follow. Now as for what I paid it was a steal. I paid taxes in safety, etested $2400 on the road. It had 180000Km and 2550 hours on the idle clock. Now it did have a pretty bad shake in the front end so I think they just wanted to unload it. The dealer I bought it from bought lots of them. He would get them for his taxis buddies and the left overs he would sell to the public. It turns out it had a bent rim. That was it. Replaced it and drives great. My plans are to fully restore it to original OPP markings once there are no more CVPI's on the road and with the OPP's permission.
