No. The death penalty is generally restricted to premeditated murder. This is at most a first-degree felony (statutory max: 30 years), unless he hits the "what do you mean, make the punishment fit the crime?" (aka "three strike") laws, in which case it could go to life.

If he's facing a three-strikes sentence, that may be why he fled the scene - people are more likely to do that if they're facing insanely long prison terms anyway.

I hope they'll bust him soon. I... how it say easily...dont like when "people" do such horrible things...In Russia he would have already been dead arrested. SOBR works fast you know )

Wait a minute, He ran? What an absolute cowardly act. I can understand being scared of being arrested, but really? If i plowed into a damn day care I would be more concerned about the children than being arrested.
